The key boundary: RDW handles the information needed to sell, deliver, support, secure, and improve Daylark. Homeschool records you place directly into your own ChatGPT and Notion accounts are handled by those platforms under their policies.
1. Scope
This Privacy Policy explains how RDW LLC, a Kentucky limited liability company (“RDW,” “Daylark,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information in connection with the Daylark website, purchases, customer support, state-specific guide packages, updates, and related services (collectively, the “Service”).
This policy does not govern third-party platforms you use with Daylark, including ChatGPT and Notion. Those companies independently determine how they handle information submitted to their services. Review the OpenAI Privacy Policy and Notion Privacy Policy before placing family or student information into those platforms.
2. Information we collect
Information you provide to RDW
- Purchase and entitlement information: name, email address, billing address, state selection, product purchased, transaction date, and payment status. Payment providers process full card or bank details; RDW generally receives transaction and limited billing information rather than complete payment credentials.
- Communications: information you include when contacting support, requesting a refund, responding to a survey, joining a community, or otherwise communicating with us.
- Product setup and support information: information you choose to provide so we can deliver the correct state package, troubleshoot installation, or answer a question.
- Feedback: suggestions, testimonials, ratings, or other feedback you voluntarily provide.
Information collected automatically
When you visit the website, we and our hosting or security providers may automatically receive technical information such as IP address, browser and device type, operating system, referring page, pages visited, approximate location derived from IP address, timestamps, and information about errors or interactions. We may use cookies, local storage, or similar technologies that are necessary to operate, secure, and remember preferences on the site.
Information stored in ChatGPT and Notion
Daylark is designed so that homeschool plans, student records, photos, audio, worksheets, progress notes, and similar Family Content can be created and stored in accounts you control on third-party platforms. RDW does not automatically receive all content in those accounts merely because you use Daylark. RDW may receive specific content if you intentionally send it to us for support, enable a future integration that expressly transmits it to us, or otherwise authorize access.
3. How we use information
We use personal information to:
- process purchases and deliver the correct Daylark and state-specific package;
- authenticate entitlements and provide installation, onboarding, support, and updates;
- respond to questions, privacy requests, disputes, and feedback;
- operate, maintain, secure, debug, and improve the Service;
- understand general product usage and performance;
- prevent fraud, misuse, security incidents, and violations of our Terms;
- communicate about material product or policy changes and, where permitted, relevant Daylark offerings;
- comply with law and protect the rights, safety, privacy, and property of users, RDW, and others; and
- create aggregated or de-identified information that does not reasonably identify a person.
We do not sell personal information. We do not use student information supplied to us for targeted advertising, and we do not knowingly allow third parties to use it for targeted advertising.
4. How we disclose information
We may disclose personal information in the following circumstances:
- Service providers: to providers that perform hosting, security, payment processing, email delivery, customer support, analytics, document delivery, and similar functions for us, subject to appropriate restrictions.
- Third-party platforms you direct us to use: when you ask Daylark to connect with or send information to ChatGPT, Notion, a plugin, app, community, communications tool, or another service.
- Legal and safety reasons: when reasonably necessary to comply with law or legal process; investigate fraud, abuse, or a security issue; enforce our agreements; or protect a person’s rights, safety, or property.
- Business transactions: in connection with a financing, merger, acquisition, reorganization, sale of assets, or similar transaction, subject to applicable law.
- With your direction or consent: when you authorize a disclosure.
We do not disclose student information to schools, districts, evaluators, co-ops, family members, or other people unless you direct or authorize that sharing, or disclosure is legally required.
5. Children’s privacy and parent-directed use
Daylark is marketed to and intended for parents and legal guardians, not for independent use by children. A child under 13 may not purchase Daylark, create a direct account with RDW, contact us independently, or submit personal information directly to RDW.
Parents and guardians may choose to manage information about their children through Daylark using third-party accounts they control. The adult is responsible for supervising use, selecting what information to provide, configuring permissions, and reviewing the privacy terms and age requirements of ChatGPT, Notion, and any other connected service.
If we learn that we collected personal information directly from a child under 13 without legally sufficient parental authorization, we will take reasonable steps to delete it. A parent or guardian may contact us at the address below to request access to or deletion of information they believe a child submitted directly to RDW.
Consistent with the Federal Trade Commission’s children’s privacy guidance, we aim to collect no more child-related information than reasonably necessary for a parent-directed request, use it only for the requested purpose, retain it only as long as reasonably necessary, and protect it with reasonable safeguards.
6. Your choices and privacy rights
Depending on where you live, you may have rights to request access to, correction of, deletion of, or a portable copy of personal information we hold about you; to opt out of certain processing; or to appeal a privacy-request decision. You may also withdraw consent where consent is the basis for processing.
To make a request, write to the address in Section 12 and describe the request. We may need to verify your identity and authority before responding. An authorized agent may submit a request where permitted by law, but we may require proof of authorization. We will not discriminate against you for exercising an applicable privacy right.
You can manage or delete content stored in ChatGPT or Notion through the controls provided by those platforms. Requests concerning information held solely by those providers should be directed to them.
7. Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including delivering purchased access, maintaining transaction and tax records, providing support, resolving disputes, enforcing agreements, meeting legal obligations, and protecting the Service.
Retention periods vary by information type and context. When information is no longer needed, we take reasonable steps to delete, de-identify, or securely isolate it. Information stored in your third-party accounts is retained under those providers’ policies and your account settings.
8. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No internet service or storage system is completely secure, and we cannot guarantee absolute security.
You are responsible for securing your devices, email, ChatGPT and Notion accounts, passwords, share links, workspace permissions, and backups. Do not share credentials with us. Notify us if you believe an interaction with RDW has created a security risk.
9. Cookies and analytics
The website may use essential cookies, local storage, and similar technologies for navigation, preferences, security, fraud prevention, and site operation. Hosting and analytics providers may collect technical usage data on our behalf. If we introduce non-essential advertising or cross-site tracking technologies, we will provide notices and choices required by applicable law.
You can control many cookies through your browser settings. Blocking essential technologies may affect website functionality.
10. International use
RDW is based in the United States, and information we handle may be processed and stored in the United States or other places where our service providers operate. Those locations may have different data-protection laws than your location. Where required, we use lawful safeguards for international transfers.
11. Changes to this policy
We may update this Privacy Policy as Daylark evolves or legal requirements change. The “Effective” date shows when the current version took effect. If a change materially affects how we use personal information, we will provide notice as required by law.
